Terms of Rental


Terms & Conditions of Rental


A provisional reservation may be made by e-mail upon which we will hold your requested dates for 7 days. Once you have read our terms & conditions of rental, if you wish to confirm the booking you should complete the booking form and use the PayPal link provided to pay the deposit due. By submitting the booking form you are confirming your agreement to the following terms & conditions. The person who signs the booking form certifies that he/she is authorised to agree to the terms & conditions on behalf of the other guests in the party as listed on the booking form as well as those that may be substituted at a later date and that those other parties also agree to the terms and conditions. The signatory must be over 21 years of age.


If you are booking more than 8 weeks in advance of your arrival date then a deposit of $130 for each week of rental is required to confirm the booking and reserve the dates requested. This deposit is non refundable but may at the sole discretion of the owners be refunded under extenuating circumstances and in the event that the dates are then rented out at the same or higher rental. A security deposit of $200 is payable with the balance and is refundable on satisfactory inspection by our management after you have vacated the premises.

Balance of Payment

The balance of the rental amount is due no later than 8 weeks prior to your arrival date. We reserve the right to cancel the booking if the payment is not received by the due date and in such circumstances the deposit will not be refunded.


The guest may cancel the booking at any time after it has been confirmed. You must ensure we receive the cancellation by informing us if you have not received an acknowledgement of cancellation within 7 days of your cancellation. If this cancellation is made more than 8 weeks before your arrival date then the deposit will be forfeited. If the cancellation is made less than 8 weeks before your arrival date and after you have paid the balance due in full then the full rental amount will be forfeited although the security deposit will be refunded. If through circumstances beyond our control it is necessary for us to cancel the booking then we will refund all monies paid in full with no further compensation or interest due.


We only accept payment via PayPal.


Alterations to confirmed bookings can be requested and will be allowed at the sole discretion of the owner. Changes must be made in writing and a new booking form submitted.


Florida State law prohibits subletting, sharing or assigning. Therefore only the persons named on the booking form are allowed to stay in the home and any contravention of the above will render the booking void. All monies paid will be forfeited and you will be asked to vacate the premises immediately and without compensation. This does not prohibit you from inviting guests as long as they do not stay overnight. Breakages, loss and damage to items of Inventory No items of inventory are to be removed from the house with the exception of the beach towels that may be taken to the beach or water park. Inventory is checked on departure and any damaged or missing items are reported to the owner. The guests agree to pay the full cost of any breakages, losses or damage to the property incurred during your stay which have been caused by the guests. Our management company will be sole arbitrators on cause of damage and you should report any accidental damage to property to the management at the earliest opportunity. On arrival at the villa you should report to management anything that you consider to be broken or not working correctly.


The homeowners and management company do not accept any liability whatsoever for death, personal injury, accidents, loss or damage to persons or personal effects however caused as a result of the use of the home including the pool and spa. It is the responsibility of an adult member of the party to ensure that children are supervised properly when in and around the pool and spa. The patio door allowing access from the house to the pool area has been fitted with a self closing self latching device so that the door closes automatically after each opening and can only be opened by unlatching at a high level making it impossible to open by a small child. This safety feature meets Florida pool barrier code but it is expressly the responsibility of all guests to ensure that the door does in fact close after each opening and that in the event that the door does not close properly that this failure to close is reported immediately to the management for urgent attention. Neither the home owner nor the management company will be held responsible for the loss of services which can fail temporarily during bad weather, nor for the consequences of the actions taken in the vicinity by any authority or utility company over which there is no control by the owner.



Guests are strongly recommended to take out adequate holiday insurance to cover eventualities such as cancellation, sickness, accident etc. The homeowners and their management do not accept any liability for loss or delay occasioned by any of the following. Strikes, riots, political unrest, global pandemics, war or threat of war, terrorist activities, industrial disputes, fire, flood, technical or weather relayed problems to transport/airport or any event beyond the control of the owner. Airplane captains are legally entitled to deny boarding to any persons who appear unfit to fly. Any passenger in a condition unacceptable to the captain and is refused passage will be deemed as giving notice of cancellation of the rental of the home.

Arrival & Departure

The rental shall commence at 4 p.m. on the day of arrival and ceases at 10 a.m. on the day of departure. Stays beyond 10 a.m. on the day of departure can only be arranged with management if there are no guests arriving on the day of your departure. If a later checkout can be accommodated there will be a charge of $65 that will be deducted from the security deposit amount to be refunded.

Complaints or Dissatisfaction

We sincerely hope that you do not have any cause for complaint as our home is maintained to an exceptionally high standard by ourselves and our very efficient management company. In the unlikely event that you wish to make a complaint you must contact the management company and give them an opportunity to resolve any issues while you are there.

Internet Usage

Whilst the home is equipped with an internet broadband connection, this can only be used via your own personal wireless enable computer or tablet/phone. We do not charge for this service but equally cannot guarantee that it will be working at any given time. We will not make any offer of compensation in the event that you are unable to access the internet.

Pool Lighting

The pool area and the surrounding landscaping is illuminated at night with a mixture of fibre optic cables and low voltage LED lighting. There are numerous fibre optic illuminator boxes and transformers all of which can fail at any given time. The system is serviced by the owner every 3 months but should a portion of lighting effects not be working during your stay this should only be reported to management if it adversely affects your enjoyment of the villa. If the main pool light is not working this must be reported to management. Whilst our website photos show the pool area at its most perfect we do not accept any liability should the effect be reduced by one or more bulbs not working.


The homes on either side of the villa are residential and not holiday homes. We therefore request that out of respect for your neighbours that noise be kept to a minimum between the hours of 10p.m. & 8a.m.

No Smoking Policy

Our home is a strict non smoking home although smoking is permitted in the lanai area outside. Should the cleaners feel on inspection of the home that there are signs that smoking has occurred inside the house we reserve the right to withhold your security deposit in order to pay foe ionization.


No pets of any kind are permitted on the premises with the exception of a guide dog which may incur additional cleaning fees.


All utilities such as water, gas, electric and cable tv are included within the rental fee.

Pool Heating

If pool heating has been requested and paid for, the owners cannot guarantee a specific pool temperature as it is, during winter months very dependent on the ambient temperature on any given day. The electric heater is set to reach 88 degrees but if the daytime temperatures are below 55 and the overnight temperature drops to below 45 the pool will lose heat overnight and may not reach 88 during the day. The heater is still running but is not able to raise the temperature to 88 even if running all day. The water even at 82 to 84 will still feel warm in the low ambient temperature of 55 or below. We do not offer refunds if the pool temperature is not as high as 88 on any given day. If staying between October and March there will be a blue solar blanket fitted on the pool. This must be removed for swimming and replaced at the end of the day to retain the heat overnight.

Use of Telephone

A telephone is available for your use and is free to all local numbers.   Please do not make international calls from this phone.



Due to the complexity and expense of the pool and spa equipment there are CCTV cameras that monitor the West side of the property from the front lawn to the rear gate. These cameras have been very successful in detecting the occasional problem with the pool equipment and the sprinkler system and to date have saved us over $5000 in the past 10 years. There is no reason for guests to exit the pool screen on the West side nor walk on the front lawn but should you do this you may be recorded on the video recorder. Please be assured these cameras do not infringe on privacy as they do not cover the front entrance nor any aspect of the pool area. This will be evident on arrival.

Guests agree To :-

1) Take good care of the home and its property and to leave it in a clean and tidy condition at the end of the stay.

2) Abide by the conditions above.

3) Permit the management reasonable access to carry out any repairs or maintenance as required.

4) Report any damage, loss, breakage, problem or concern immediately that it is discovered to the management company.

5) Accept the terms and conditions above.
